1) Subject and scope

These general terms ("Terms") govern the use of epicsicily.it ("Site") and the booking of tourist experiences and services ("Services") offered by Epic Sicily Srl ("Epic", "we"). Epic acts as a qualified intermediary: we select local hosts and operators ("Hosts") and connect them to customers, managing the contractual relationship throughout the booking lifecycle, also after confirmation.

These Terms apply to contracts concluded via the Site pursuant to D.Lgs. 70/2003 (e-commerce), D.Lgs. 206/2005 (Consumer Code) and, where applicable, D.Lgs. 79/2011 (Tourism Code).

2) Contract formation

A booking is placed online by filling the form for each experience, accepting these Terms and the privacy notice, and completing payment authorisation. A receipt is sent via WhatsApp and email to the address provided by the customer. The contract is finalised only when the Host confirms availability: at that point the payment is captured. If the Host does not confirm within the applicable window (up to 6.5 days from booking, or 24 hours before the experience starts, whichever comes first), the pre-authorisation is released and no amount is charged.

3) Prices and payment

Prices include VAT where applicable. Payment is made online by credit/debit card processed by Stripe Payments Europe Ltd. At booking time we place an authorisation (hold) on the card without charging it. The amount is captured only after the Host confirms. If the Host declines or fails to confirm, the authorisation is released automatically.

Epic Sicily will issue an invoice/receipt compliant with Italian law. For experiences delivered directly by Hosts, the fiscal document may be issued by the Host where allowed by law.

4) Changes, cancellations and refunds

As leisure services to be supplied on a specific date or period, the right of withdrawal under arts. 52 et seq. of the Consumer Code does not apply (art. 59(1)(n), D.Lgs. 206/2005). Subject to different terms stated in the individual experience page, the following cancellation rules apply:

  • Free cancellation up to 48 hours before the experience starts, with full refund.
  • Cancellation between 48 and 24 hours before: 50% refund.
  • Cancellation less than 24 hours before, or no-show: no refund.
  • Cancellation by the Host or by Epic for reasons not attributable to the customer (e.g. weather, sudden unavailability): full refund or rescheduling at the customer's choice.

Refunds are issued via the same payment instrument used for the booking, within 14 days of accepting the request. Requests must be sent via WhatsApp or to the email address provided.

5) Customer obligations

The customer agrees to provide accurate, up-to-date information at booking, to arrive on time at the meeting point, and to behave during the experience in accordance with law and the Host's instructions. For activities involving risk (water sports, horse riding, high-altitude excursions, flights) the customer represents that they are fit for purpose and accepts the typical risks of the activity, without prejudice to the Host's duty to adopt all required safety measures.

6) Epic Sicily's role

Epic Sicily acts as a qualified intermediary and manages communication between customer and Host throughout the booking lifecycle, including automatic translation and multilingual support. All booking-related communications must pass through Epic's official channels (WhatsApp, email). The experience is delivered by the local Host who bears operational responsibility; Epic is liable within the limits of its intermediation and Host selection activity.

7) Limitation of liability

To the extent allowed by law, Epic Sicily's liability to the customer on any account is limited to the amount of the individual booking. Mandatory rights granted to consumers by the Consumer Code and Tourism Code are unaffected, including liability for personal injury arising from wilful misconduct or gross negligence.

8) Complaints and dispute resolution

Any complaint must be sent without undue delay to info@epicsicily.it, providing the booking code and a description of the facts. Epic will respond within 15 business days. Pursuant to Reg. EU 524/2013, EU-resident consumers may use the European Commission ODR platform at ec.europa.eu/consumers/odr.

9) Governing law and venue

These Terms are governed by Italian law. For consumer disputes, jurisdiction lies with the court of the consumer's residence or domicile if located in Italy (art. 66-bis Consumer Code). For business customers, exclusive jurisdiction lies with the Court of Palermo.

10) Changes to these Terms

Epic Sicily may update these Terms for regulatory or organisational reasons. Changes take effect on publication of this page with the update date. Existing bookings remain governed by the Terms in force at the time of their conclusion.
